1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the DIVAS Discord bot ("DIVAS," "the Bot," "we," "us," or "our") and this accompanying website ("the Site"). By inviting DIVAS to a Discord server, interacting with DIVAS in any server, or accessing the Site, you agree to be bound by these Terms. If you do not agree, do not use DIVAS or the Site.

If you are using DIVAS on behalf of a Discord server, community, or organization, you confirm that you have the authority to accept these Terms on that entity's behalf, and "you" refers to both you individually and that entity.

2. Eligibility

You must meet Discord's own minimum age and account requirements to use DIVAS, as set out in Discord's Terms of Service. By using DIVAS, you represent that you satisfy those requirements and that your use of DIVAS complies with all applicable laws in your jurisdiction.

3. Discord Account Requirements

Interacting with DIVAS requires an active, standing Discord account in good faith. You are responsible for maintaining the security of your own Discord account and for all activity that occurs through it, including any verification actions performed while logged in.

• You must not use an account you do not own or are not authorized to use.
• You must not use automated scripts, self-bots, or alternate account networks to interact with DIVAS.
• Server owners inviting DIVAS must have the "Manage Server" permission or equivalent authority on that server.

4. Bot Usage

DIVAS provides Discord server verification and related community-safety features, including but not limited to member verification, role assignment, and basic anti-raid detection. Features may vary by server configuration and by version, and are described in more detail on the Verification page.

DIVAS is provided for use within Discord servers that have lawfully added the bot through Discord's official invite and OAuth2 authorization process. Any use of DIVAS outside of this intended context is not supported and may violate these Terms.

5. Verification System

DIVAS's verification system is designed to confirm that a joining member is a genuine, present participant and to help reduce automated or malicious joins. Verification is a safety measure, not a guarantee — it reduces risk but cannot eliminate it entirely.

• Server administrators are responsible for configuring verification settings appropriately for their community.
• Passing verification grants access according to the roles configured by the server's administrators, not by DIVAS itself.
• DIVAS may update its verification checks over time to respond to new abuse patterns.

6. User Responsibilities

When using DIVAS, you agree to:

• Provide accurate interactions with the verification flow (e.g., not attempting to trick or bypass checks).
• Use DIVAS only for its intended purpose of server verification and safety.
• Comply with Discord's Terms of Service and Community Guidelines at all times.
• Respect the rules and configuration set by the individual server you are interacting with DIVAS in.

7. Prohibited Activities

You may not, and may not attempt to:

• Reverse-engineer, decompile, or probe DIVAS in an attempt to bypass verification or security checks.
• Use DIVAS to facilitate raids, spam, harassment, or any other disruptive or malicious activity.
• Interfere with, overload, or disrupt the servers or networks that DIVAS relies on.
• Use DIVAS in connection with any illegal activity or in violation of Discord's own policies.
• Impersonate DIVAS, its developers, or server staff.
• Resell, sublicense, or misrepresent DIVAS as your own product without authorization.

8. Abuse & Exploitation

Any attempt to exploit bugs, vulnerabilities, or unintended behavior in DIVAS for personal gain, disruption, or to circumvent verification is strictly prohibited. If you discover a security vulnerability, we ask that you report it responsibly through the Contact page rather than exploiting or publicly disclosing it.

We reserve the right to restrict, rate-limit, or block accounts, servers, or IP ranges that we reasonably believe are engaged in abuse of the Bot.

9. Moderation

Day-to-day moderation of individual Discord servers remains the responsibility of that server's own administrators and moderators. DIVAS provides tools to support server safety but does not moderate server content, messages, or member conduct beyond its stated verification and anti-raid functions.

We reserve the right, at our discretion, to deny, suspend, or revoke DIVAS's availability to any server found to be using the Bot to facilitate harm, in violation of these Terms or Discord's policies.

10. Data Handling

DIVAS processes limited data as necessary to provide verification functionality. What is collected, why, and for how long is described in full in our Privacy Policy, which forms part of these Terms by reference.

11. Third-Party Services

DIVAS operates on top of the Discord API and platform, and its availability depends on Discord's continued operation and policies. DIVAS may also rely on third-party hosting, monitoring, or infrastructure providers. We are not responsible for outages, data handling, or policy changes originating from Discord or other third-party providers outside our control.

12. Availability

We aim to keep DIVAS available and responsive, but we do not guarantee uninterrupted, error-free, or continuous operation. DIVAS may be temporarily unavailable due to maintenance, updates, third-party outages (including Discord itself), or circumstances beyond our reasonable control.

13. Changes to the Service

We may modify, update, add to, or remove features of DIVAS at any time, with or without notice, to improve functionality, security, or compliance. We may also update these Terms periodically; continued use of DIVAS after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.

14. Termination

You may stop using DIVAS at any time by removing it from your server or ceasing interaction with it. We reserve the right to suspend or terminate DIVAS's access to any server, or to block specific users, at our discretion — including for violations of these Terms, abuse, or at the request of Discord.

15. Limitation of Liability

DIVAS is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, DIVAS or the Site — including damages related to server security incidents that occur despite the use of verification.
